What Counts as a Substandard Quality Product?
Under the Consumer Protection Act 2019, a product is considered defective — and the seller/manufacturer is liable — when it suffers from any fault, imperfection, or shortcoming in quality, quantity, potency, purity, or standard, as required by law or as the seller expressly or impliedly represents. In plain terms, if what you receive does not match what was promised — whether on the label, in the advertisement, or by the seller at the time of sale — you have a valid consumer complaint.
Substandard quality products in the FMCG category include: cosmetics causing skin rashes or chemical burns contrary to the "dermatologically tested" claim; mineral water bottled below BIS standards with contamination; household cleaning agents that are far weaker than the stated concentration; packaged food products that are spoiled or of inferior quality despite a valid date; and baby or children's products made from materials that do not meet safety standards.
| Product Category | Substandard Issue | Applicable Standard |
|---|---|---|
| Packaged Drinking Water | Contamination, pH out of range | BIS IS 14543 |
| Cosmetics & Skin Care | Harmful chemicals, skin reaction | Drugs & Cosmetics Act / BIS |
| Household Cleaning Products | Below declared concentration | BIS / Consumer Protection Act |
| Baby & Child Products | Toxic materials, sharp edges | BIS IS 9873 / CPA 2019 |
| Packaged Food Items | Inferior ingredient quality | FSSAI Standards |
ISI and BIS Marks — What They Mean for Consumers
The Bureau of Indian Standards (BIS) is the national standards body of India. Products bearing the ISI mark (for most industrial and consumer products) or the BIS Hallmark (for gold jewellery) have been certified as meeting the minimum quality standards defined in the relevant Indian Standard. A product that carries an ISI/BIS mark but does not actually conform to that standard is not only a consumer rights violation but also a criminal offence under the BIS Act 2016.
When you buy a product with an ISI mark in Pondicherry and it fails to meet the standard — whether a packaged drinking water bottle that is contaminated, or a safety helmet that shatters under minor impact — you can file a complaint with BIS (at bispurewater.com or through their grievance portal) as well as a consumer complaint at DCDRC Puducherry for compensation. BIS can initiate criminal prosecution against the manufacturer, in addition to your civil remedy.
Manufacturer vs Retailer Liability
A frequently asked question in product quality disputes is: can I sue the retailer, or only the manufacturer? Under the Consumer Protection Act 2019, both the manufacturer and the seller can be made opposite parties in the same consumer complaint. The retailer who sold you the substandard product in Pondicherry is liable along with the manufacturer — particularly where the retailer made specific representations about the quality of the product. This makes it much easier for consumers to file locally, naming the Pondicherry-based retailer along with the distant manufacturer.
Product liability under the Consumer Protection Act 2019 (Chapter VI) also allows for a "strict liability" approach — meaning you do not need to prove negligence. You only need to show that the product was defective and that the defect caused you harm. This is a powerful provision that has significantly strengthened product quality complaints in India.
Claiming Refund and Compensation at DCDRC
