Grounds for Claim Rejection and How to Fight Back
When a life insurance company in Pondicherry rejects a claim, they typically cite one of a handful of standard grounds. Understanding each ground — and the legal arguments that defeat it — is key to winning your consumer court case at DCDRC Puducherry or SCDRC Pondicherry.
Non-Disclosure of Pre-Existing Condition — Is It Valid?
The most common basis for life insurance claim rejection is alleged "non-disclosure" of a pre-existing medical condition at the time of policy issuance. Insurance companies argue that the policyholder concealed a condition like diabetes, hypertension, or heart disease when completing the proposal form.
Consumer courts and the Supreme Court of India have firmly held that:
- Non-disclosure must be material — it must have influenced the insurer's decision to issue the policy
- If the insurer issued the policy after conducting a medical examination and the condition was or should have been discovered, the insurer cannot later claim non-disclosure
- If the policyholder genuinely did not know about the condition at the time of proposal, non-disclosure cannot be attributed to deliberate concealment
- After the 2-year contestability period (discussed below), non-disclosure claims by insurers are extremely difficult to sustain
Suicide Clause — After 1 Year, Claim Must Be Paid
Under Indian insurance law and IRDAI regulations, suicide within the first year of a life insurance policy may be excluded. However, after 1 year from the policy commencement date, the suicide clause does not apply — the insurer must pay the full sum assured or at least 80% of the premiums paid. Many insurance companies in Pondicherry wrongly reject suicide-related claims even after the 1-year period, which is a clear deficiency in service actionable at DCDRC Puducherry.
Nominee Dispute — Wrong Nominee Named
When the policyholder has named a nominee but the claim is disputed by legal heirs who are not nominees, or when the nomination itself is challenged as invalid, insurance companies often withhold payment. Consumer courts in Pondicherry have held that insurers must pay the claim to the valid nominee as per the nomination on record, and disputes among legal heirs are to be resolved separately — not used to withhold the insured amount indefinitely.
Policy Lapsed — Company's Fault in Premium Collection
If the insurer's ECS/NACH failure, banking error, or administrative oversight caused the policy to lapse — and the policyholder was not adequately notified — the insurer cannot then reject a claim citing lapse. Insurers have a duty to proactively inform policyholders about premium dues and imminent lapse. Failure to do so and then using the lapse as a rejection ground is a consumer deficiency.
Death Certificate / Cause of Death Dispute
Insurers sometimes reject claims by disputing the cause of death recorded in the death certificate — claiming that the actual cause is different from what the certificate states, and that the different cause falls under an exclusion. Consumer courts in Pondicherry have held that medical death certificates issued by qualified physicians are presumptively valid, and insurers bear the burden of proving that the actual cause of death was different.
2 Years Contestability Period Rule — Know It
Under Section 45 of the Insurance Act, 1938 (as amended), an insurer can contest a life insurance policy on grounds of non-disclosure or misrepresentation only within 3 years from the date of policy issuance. After this period, the policy becomes incontestable and the insurer cannot repudiate the claim on the basis of alleged non-disclosure at the time of proposal.
Insurance Ombudsman vs Consumer Court — Strategic Choice
For life insurance claim rejections in Pondicherry, the strategic choice between the Insurance Ombudsman and DCDRC Puducherry depends on your specific situation:
- Use the Ombudsman if your claim is under Rs. 30 Lakhs and you want a fast resolution without litigation
- Use DCDRC Puducherry if you want mental agony compensation, punitive damages, and a legally enforceable order that carries the threat of execution proceedings
- Both forums can be used sequentially — if the Ombudsman rules against you, you can still approach the consumer court
